Buyer’s Security

1.       Guarantee of Buildability. Properties of New York (PONY) guarantees that the property to be conveyed to Purchaser is able to support the construction and use of one single-family residence with on-site water and septic system. If the Purchaser is unable to obtain the required approvals for a detached, single-family structure of typical design and size to be constructed somewhere on the property within one year from date of purchase, PONY shall buy back said property from Purchaser for the full purchase price.  

2.  Warranty Deed. The title of each parcel is transferred by warranty deed.  The warranty deed is generally considered the most secure deed to obtain.  By providing a warranty deed the grantors (sellers) guarantee that they hold clear title to the land and that they have the right to sell it to the grantee (purchaser).

3.  Property Survey.  All property sold by PONY has been surveyed by a New York State Licensed Surveyor.  A reference copy of the map is available to the buyer upon request. A copy of the map re-certified to the buyer can be obtained at a greatly reduced cost directly from the surveyor. This can be arranged through PONY.  Lots are staked-out in the field and upon request buyers can be walked around the perimeter of the lot prior to closing on the property.

4.  Title Insurance.  PONY obtains title insurance on all property at the time of purchase.  This ensures that the title to the property is free and clear at the time of sale. 

5.  Property Information Sheet.  All buyers are given a Property Information Sheet which contains information such as school district, latest school and property taxes, telephone and utility providers in the area, local contractors in the area and all deed restrictions and covenants on the property.

6.  Deed Restrictions and Covenants.  PONY’s property is sold with certain deed restriction and covenants which serve to maintain the character of the land and protect the property value.
